GLSEN Lauds Resolution Regarding CA Transgender Student

NEW YORK, July 24, 2013 – The following is a statement from Dr. Eliza Byard, Executive Director of GLSEN, the Gay, Lesbian & Straight Education Network , on the comprehensive resolution agreement reached between the Arcadia Unified School District; the U.S. Department of Education, Office for Civil Rights; and the U.S. Department of Justice, Civil Rights Division, which resulted from complaints of discrimination against a transgender student which were actionable under Title IX.
“This resolution agreement is a tremendous victory for Arcadia’s students and educators and completely aligns with previous school safety guidelines and framework provided by the Departments of Education and Justice and supported by GLSEN. The Arcadia Unified School District is set to take measured and evidence-based steps to ensure the school district is safer and more affirming for all students, including transgender and gender nonconforming students.
“GLSEN is pleased that the interventions outlined in the resolution agreement reflect the school-based solutions we have recommended for years and which are incorporated in our Model District Policy on Transgender and Gender Nonconforming Students. We hope this development will not only provide necessary closure for the student and their family, but also offer the community an opportunity to envision a future where all students across California are able to receive an education free from harassment and discrimination.”
The joint effort between the Departments of Justice and Education resulted in a comprehensive agreement that includes clear directives for addressing gender-based discrimination within the school district including the development of transgender inclusive policies, mandatory district-wide training and reporting. The resolution will benefit almost 1,000 students enrolled in the Arcadia Unified School District.
Within existing law, this partnership between the Departments of Justice and Education has resulted in similar settlements of tackling bias-based bullying and discrimination with federal support and assistance.
GLSEN has championed this shift in Washington for the past decade to ensure that creating safer schools for all students is a federal priority. GLSEN will continue to invest its resources into federal legislation like the Safe Schools Improvement Act and the Student Non-Discrimination Act that protect all students in school from bullying and harassment.
